Totalis Behavioral Health, Inc. (“Totalis“, “we” or “us“) operates the website located at www.TotalisBH.com (the “Site”) and offers certain services related to ABA therapy and similar services (“Services”).  We respect the privacy of our users, site visitors and clients.  This Privacy Notice and any documents the Notice expressly incorporates by reference (collectively, the “Notice“), explains the type of personal information and health information (your “information”) that we collect and how we collect, use, access, disclose, safeguard, store and otherwise process your information.  Should we have an agreement in place for the provision of our Services, then your information would also be covered by the Notice of Privacy Practices provided to you.

We may need to make changes to this Notice as privacy laws change, our Services evolve, or we add or change service providers among other things. As a result, we reserve the right to make changes to this Notice at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of this Notice. Any changes or modifications will be effective immediately upon posting the updated Notice on our Site at www.TotalisBH.com. Your continued use of the Site or Services following the posting of changes to these terms means you accept the updated Notice.

INFORMATION WE COLLECT

1) Information we may collect directly from you, including through your use of the intake form available on the Site:

  • Personal information that identifies you, such as your name and contact details including phone number, email address, street/mailing address, zip code only, telephone or fax number, and area code only.
  • Financial or payment information, such as name, billing address and payment card details, including credit card numbers, expiration dates, and security codes (which are collected by our third-party payment processor(s) on our behalf) in the event you procure any Services from us;
  • Insurance information, such as policy number, insurance details and policy information;
  • Marketing related communications, including your preferences for receiving our communications and details about your interest in our Services we provide;
  • Professional or employment related Information you provide, such as your current position, job title, employer, or location, that you may provide should you apply for employment with us; and,
  • Other information, including health related information you submit to us through communications, providing information on the intake forms, through receiving our Services, reporting a problem, emailing with us, or otherwise. Protected health information we collect shall also be subject to the Notice of Privacy Practices that you consent to as a result of receiving Services from us.

2) Information shared by others about you:

  • Certain information about you that is shared with us by third parties, including but not limited to, our service providers and other business partners, physicians, schools, insurance companies, other therapists, and other third parties.
  • When your information is shared with us by family members or legal guardians, who may contact us in relation to providing Services to you.

3) Information we may obtain about you from your usage of our Site or by automated means:

  • Data, such as preferences, usage data, comments, performance metrics, and similar data collected by the Site;
  • Derivative data and usage information, such as technical information related to your use of the Site, including device name and type, IP address, other set up data, operating system, browser type, access times, pages viewed, other interactions with the Site which are automatically collected and stored in log files;
  • Data from social media sites, such as comments, feedback or content posted on our social media pages; including Facebook, X, Instagram and LinkedIn;
  • Geolocation and GPS data, including the physical location of your device(s); and
  • Cookies, web server logs, web beacons and other technologies (See also Cookies Section below).

HOW WE USE THE INFORMATION WE COLLECT

We use your information for the following purposes (provided, any protected health information of our clients is governed by the Notice of Privacy Practices):

  • For treatment purposes, including providing you with information regarding our Services, or providing, coordinating or managing our Services with you;
  • To improve the quality of our Services, train staff, conduct audits, and manage our business; 
  • For payment purposes, including verifying insurance information;
  • For compliance with a legal, regulatory or relevant agency obligation, including this Notice, or enforcing our Terms of Use, or other contracts you have entered into with us;
  • To protect against, identify and prevent fraud or other criminal activity, claims and other liabilities, that we may notice based upon any activity or your use of the Site;
  • To monitor your use of the Site as part of any routine support and maintenance of the Site;
  • For improving the security and other related system and network functions including preventing misuse;
  • To perform analytics, including trend analysis, market and consumer research, anonymization and aggregation of personal information; and
  • To conduct marketing activities in accordance with applicable laws. 

HOW WE SHARE YOUR INFORMATION

1 ) We may share your information in the following limited situations:

  • With respect to protected health information, to those parties and for those purposes also set forth in the Notice of Privacy Practices;
  • With your consent;
  • With authorized individuals, that you let us know may receive your information, including to communicate with schools, doctors, therapists, and other service providers for care planning and coordination;
  • With our third party service providers, which have contracts in place with us in order to facilitate in providing the Services to you including processing, storage, and technical assistance in relation to our operation of the Site or provision of the Services, such as IT providers, cloud storage providers, software providers, etc., including automated technology to collect and analyze your information to help us understand your use and optimize your experience (please see our section on Cookies to learn more); 
  • With insurance companies, including to verify insurance benefits, obtain pre-authorizations, submit claims and respond to insurance requests with your written authorization;
  • With business associates, as that term is defined under HIPAA, in the provision of our Services to you or who perform certain functions such as billing, provided these business associates are required by law and by contract to protect your information and comply with HIPAA;
  • For health oversight activities such as inspections or audits by applicable agencies;
  • To exercise or defend any claims to protect our legal rights;
  • With billing services or collection agencies in the event use of those services is required;
  • With professional advisors and governmental authorities, if we believe in good faith that disclosure, access, use or preservation of such information is necessary to (i) meet any applicable law, regulation, legal process or governmental request; (ii) enforce or investigate your compliance with the terms of any of our contracts or policies we have with you for potential violations; (iii) protect against physical, financial or other harm against the rights, safety or property of you, us, or any third-party; and, (iv) investigate fraud, technical, security or other operational issues; and
  • In connection with corporate transactions, meaning changes to our corporate structure due to sale, transfer, merger or other reorganization of our company during which your information may be transferred.

2 ) We may share your non-personal information (including aggregated or anonymized data) through creating aggregated, de-identified and/or anonymized data from your personal information and other individuals whose personal information we collect.  We may make personal information into de-identified and/or anonymized data by removing information that makes the data identifiable to you, in accordance with applicable laws.  We may use this aggregated, de-identified and/or anonymized data and share it with third parties and service providers for our lawful business purposes, including to analyze and improve the Services and promote our business.  We will not attempt to re-identify any such data, except as permitted by law.

YOUR CHOICES

In this section, we describe the rights and choices available to Site users and clients regarding their information.  More specifically, you can request that we perform the following actions regarding your information:

  • Access, correct, or update your information. 
  • Receive a copy of your information.
  • Request limitations on our use of your information, subject to applicable laws and requirements to provide our Services.
  • Opt-out of communications. If you no longer wish to receive marketing-related communications, you may opt-out of receiving these emails by clicking “Unsubscribe” found in emails we send you.  Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.  
  • Blocking images/clear gifs. Most browsers and devices allow you to configure your device to prevent images from loading. To do this, follow the instructions in your particular browser or device settings.

Declining to provide information. We need to collect information to provide certain Services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those Services to you.

THIRD PARTY WEBSITES

Our Site or Services may include links to or use of third-party applications, products, services, or websites. If you access those links, you will leave our Site. Totalis does not control these third-party sites or their privacy practices, which may differ from Totalis’ practices. This Notice does not cover the information you choose to provide to or that is collected by these third parties. You are encouraged to review the privacy documentation of any third-party site you interact with before you allow them to collect and use your information.

Totalis may also provide social media features on the Site, or use social media in promoting the Services, such as the Facebook, Instagram, LinkedIn or X buttons, which may include some features or functionality that enable you to share information with your social networks or to interact with Totalis on various social media websites. Your use of these features may result in the collection or sharing of information, including personal information, about you depending on each specific social media website. This may include your IP address, which page you are visiting on our Site. Social media features and widgets are hosted by a third party, and your interactions with these features are governed by the privacy notice of the company providing it.

HOW WE SECURE YOUR INFORMATION

The security of your information is important to us. Totalis takes a number of precautions — including administrative, technical, and physical measures — designed to safeguard your information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction.  However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your information as a result of your use of the Site.  

WHERE YOUR INFORMATION IS USED OR ACCESSIBLE 

Totalis is located in the United States, and as such, all information will be accessed and stored there, and will be transferred there should you access our Site and live in another country.  Totalis contracts with certain service providers which may have locations in other countries, and certain information may be accessed from additional countries. Where required, we have put in place appropriate safeguards with our service providers, contractors, distributors and other business partners to try and limit any transfer of information outside of the United States. 

RETENTION OF YOUR PERSONAL DATA

We retain your information as follows:

The period during which we store your information varies depending on the purpose for the processing:

  • For the provision of our Services, for so long as you are a client or use the Services, or as required by HIPAA or other applicable laws. 
  • For marketing purposes, until you have opted out of receiving further direct marketing communications in accordance with applicable law.
  • In all other cases, we store your information for as long as is needed to fulfill the purposes outlined in this Notice or such retention period as required by law, following which time it is either anonymized (where permitted by applicable law), deleted or destroyed.

USE OF COOKIES AND OTHER DATA COLLECTION TOOLS

Like many website owners and operators, as a result of operating our Site, we or our third party service providers may use automated data collection tools such as Cookies and Web Beacons to collect certain information through your use of the Site, as follows:

o Cookies” are small text files that are placed on your device by a web server when you access a website.  To enable our systems to recognize your browser or device and to provide and improve the Site, we may use both session Cookies and persistent Cookies. We may also use Cookies to monitor aggregate usage and web traffic routing on our Site and to customize our Site. o Web Beacons” (also known as Web bugs, pixel tags or clear GIFs) are tiny graphics with a unique identifier that may be used for several purposes, including to deliver or communicate with Cookies, to track and measure the performance of our Site, or to monitor how many visitors view our Site. Unlike Cookies, which are stored on the user’s device, Web Beacons are typically embedded invisibly on web pages (or in an e-mail). 

We do not engage in any targeted advertising campaigns nor do we sell or share any of your personal information, including any health information.

MINORS

You must be at least 18 years old (or equivalent minimum age in the jurisdiction where you reside) to use the Site.  We do not knowingly collect any information of minors from their use of the Site.  However, we may collect personal information of minors as a result of providing our Services, and all information regarding minors should be provided to us by a parent or legal guardian, or directly from the minor as a result of the Services only.  We comply with applicable laws regarding the treatment of personal information involving minors. Any protected health information of minors is governed by the Notice of Privacy Practices.
