This Notice of Privacy Practices (“notice”) of Totalis Behavioral Health Inc. (“we”) describes how your (or your child’s) protected health information (collectively “information”) may be collected, used and shared, and how you can get access to this information. Please review it carefully.

OUR COMMITMENT TO YOUR PRIVACY AND HIPAA COMPLIANCE

We are committed to protecting your privacy and the confidentiality of your information. We comply with the Health Insurance Portability and Accountability Act (HIPAA) and all applicable state and federal privacy laws applicable to your information.

We keep all information you provide to us in confidence, and we use and disclose it only as described in this notice.

HOW WE COLLECT, USE, AND SHARE YOUR INFORMATION

We collect your information in several ways, including:

  • When you provide information directly to us, including in person, by phone, or during therapy sessions.
  • When you fill out forms or communicate with us via our website’s “Contact Us” page or by email.
  • When you provide information for scheduling, billing, or insurance purposes.
  • When your information is shared with us by third parties, including but not limited to, physicians, schools, insurance companies, therapists, and other third parties.
  • When your information is shared with us by family members or legal guardians.

We may use and share your information for the following purposes:

  1. Treatment
  • To provide, coordinate, or manage ABA therapy and related services, including communicating with other clinical staff we employ.
  • To communicate with doctors, therapists, schools, and other service providers involved in your (or your child’s) care, with your written authorization.

 

  1. Payment
  • To bill and collect payment from you, your insurance company, or applicable federal or state programs, or other payers with your written authorization.
  • To verify insurance benefits, obtain pre-authorizations, submit claims, and respond to insurance requests with your written authorization.
  • To share information with billing services or collection agencies as needed.
  1. Health Care Operations
  • To improve the quality of our services, train staff, conduct audits, and manage our business.
  • To a health oversight agency, for purposes such as auditing, investigations, inspections and licensing.
  • To contact you about appointments, scheduling, or changes to your care.
  1. Care Coordination
  • To communicate with schools, doctors, therapists, and other service providers for care planning and coordination, with your written authorization.
  1. Information Technology
  • To provide certain services using technology, including via telehealth platforms, using secure technology.
  • To software, applications, and cloud providers, as required to use their technology, subject to appropriate contracts in place with such providers.
  1. Disclosures to Business Associates
  • We may share your information with third-party service providers (called “business associates”) who perform functions on our behalf, such as billing, IT support, or data storage. All business associates are required by law and by contract to protect your information and comply with HIPAA.
  1. As Required by Law

We may also use or share your information:

  • When required by federal, state, or local law.
  • For public health and safety (e.g., reporting suspected abuse or neglect, preventing threat of harm to self or others), including cooperating with law enforcement agencies as we in good faith believe may be required.
  • For health oversight activities (e.g., audits, inspections).
  • In response to court orders, subpoenas, or other legal processes.
  • To exercise or defend any claims to protect our legal rights.
  1. Other Uses and Disclosures
  • For research purposes (with your authorization or as permitted by law).
  • For workers’ compensation claims.
  • For government health programs.
  • In the event of any data breach or security incident, for notification purposes.
  • As part of a merger, acquisition, bankruptcy, or other transaction in which a third party may assume control over or acquire all or part of our business.

CHILDREN’S PRIVACY

Our services are primarily provided to children, but we do not knowingly collect personal information directly from children through our website or email. All information provided to us online or in person should be submitted by a parent or legal guardian.

For patients under 18, parents or legal guardians generally have the right to access and control their child’s information. However, there may be circumstances under federal or state law where a minor patient has the right to consent to certain services or to privacy regarding specific information. In such cases, we will comply with all applicable laws regarding minor consent and privacy.

OUR SECURITY MEASURES

We use a combination of physical, technical, and administrative safeguards to protect your information, including:

  • Secure storage of paper and electronic records
  • Password protection and encryption of electronic data
  • Access controls to limit who can view your information
  • Staff training on privacy and security

YOUR RIGHTS REGARDING YOUR INFORMATION

You have the right to:

  • Get a copy of your information contained either in paper or electronic medical records.
  • Correct your information contained in a medical record if you believe it is incorrect or incomplete.
  • Request confidential communications (e.g., ask us to contact you at a specific phone number or address).
  • Ask us to limit what information we use or share (we will comply unless it would affect your care or we are legally required to share).
  • Get a list of those with whom we’ve shared your information (accounting of disclosures).
  • Get a copy of this notice at any time.
  • Choose someone to act for you (such as a parent, guardian, or legal representative).
  • File a complaint if you believe your privacy rights have been violated.

In the event we are unable to meet any of the foregoing requests, we will let you know the reasons for that, and you will have the opportunity to submit a statement with your record with any objections you may have regarding our response.

OUR RESPONSIBILITIES

  • We are required by law to maintain the privacy and security of your information.
  • We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
  • We must follow the duties and privacy practices described in this notice and give you a copy of it.
  • We will not use or share your information other than as described here unless you tell us otherwise. If you give us permission, you may change your mind at any time after that by providing us with written notice.

USES AND DISCLOSURES THAT REQUIRE YOUR WRITTEN CONSENT

We will not share your information for marketing purposes and we will not sell your information.

We will only use or disclose your information for purposes not expressly described in this notice if you give us your consent. When you provide such consent, we will use or share your information only as permitted by that consent, unless otherwise required or allowed by law as described in this notice.

You may revoke your consent provided at any time in writing. Revocation will not affect any disclosures already made in reliance on your prior consent. 

We will obtain your specific consent as required before sharing this information.
